Personal data management

Data controller:

The data controller is NEW SOFTWARE, a «Société par Action Simplifiée» with registered capital of 87, 190€ – Registered in the Paris Trade and Companies Register under the number 398 023 036, with Headquaters at 17 rue de l’Arrivée 75015 Paris. NEW SOFTWARE is represented by its Chairman, FUNECAP HOLDING. The data controller can be contacted as follows:

Purposes of data processing:

The Company collects the data of the person who has placed an order in the name and on behalf of the orderer “the Orderer” for the purposes, first and foremost, of performing the services covered by the contract formed by the GTCs and the order form signed by the Orderer, as well as to offer the Orderer services complementary to the Contract. To this end, the data provided by the Orderer may be communicated to the Company’s employees, subsidiaries of the FUNECAP Group and the Company’s service providers and subcontractors, to the extent necessary to perform the services.

Once the contract has been fulfilled, the Orderer’s contact details may be used by the Company and FUNECAP Group companies to send offers to the Orderer. The Orderer may, at any time, object to such use of his/her details in accordance with the article on the right to object below.

Categories of data concerned:

The data collected by the Company is all the data required to perform the services covered by the contract between the Company and the Orderer: data related to the Orderer’s identity, contact details and relationship with the deceased, data related to the organization of the funeral.

Data conservation period:

Unless the Orderer exercises his right to object, the Orderer’s contact details are kept for canvassing purposes for a period of three years from the end of the relationship.

The remaining data are kept only for as long as is necessary for the performance of the services. However, in the case of contracts concluded electronically, the contract is archived by the Company for a period of 10 years, in accordance with the terms of article L.213-1 of the French Consumer Code.

Access, rectification and deletion rights - Objection rights - Portability rights:

In compliance with current legislation, Orderers have the right to access, rectify and delete their personal data. They also have a right to migration and a right to object to the use of their data. These rights may be exercised by sending an e-mail to the following address: donnees-personnelles@funecap.com.

You are also informed of your right to define general or specific directives concerning the fate of your personal data after your death, under the conditions defined in article 85 of Law n°78-17 of January 6, 1978. General directives may be registered with a trusted digital third party certified by the Commission Nationale de l’Informatique et des Libertés. Specific directives concerning the present process must be registered at donnees-personnelles@funecap.com. The individual may modify or revoke his or her instructions at any time and may designate a person to carry them out.

Complaints:

In the event of complaints concerning the processing of personal data, the Orderer is invited to contact the Company at the following address: donnees-personnelles@funecap.com.

In the event of the Orderer’s dissatisfaction regarding the Company’s processing of his or her data, and in particular in the event of the Company’s refusal to exercise his or her right of objection, access or rectification, the Orderer may file a complaint with the CNIL at any time and/or refer the matter to the Public Prosecutor within three years (in the event of refusal to exercise the right of objection) or one year (in the event of refusal to exercise the right of access) of the date of notification of the refusal decision.
